Terms and Conditions

1INTRODUCTION AND ACCEPTANCE

  1. 1.1

These terms and conditions (the “Terms”) govern access to and use of the College.Money website and/or mobile interface and related services made available at College.Money (collectively, the “Platform”) by Pouring Pounds India Private Limited, a company incorporated under the Companies Act, 1956 (“PPIPL”, “College.Money”, “we”, “us” or “our”).

  2. 1.2

A person who accesses the Platform to explore, apply for or manage an education loan is referred to as the “Student”, “User” or “you”. A parent, guardian, guarantor, joint borrower or other person whose information or financial support is provided for an Application (defined below) is referred to as a “Co-Applicant”. A bank, non-banking financial company, public sector bank or other entity legally authorised to provide an education loan and participating in the Platform is referred to as a “Lender”. “Applicable Law” means any law, rule, regulation, direction, order or binding requirement in force and applicable to the relevant person, activity or information.

  3. 1.3

By selecting the acceptance checkbox and proceeding to create an account, submit an Application or otherwise use the Platform, you confirm that you have read and understood these Terms and the privacy notice made available for the relevant collection (“Privacy Notice”) and agree to be bound by these Terms. If you do not agree to these Terms, you must not select the checkbox, create an account, submit an Application or otherwise use the Platform.

  4. 1.4

These Terms constitute an electronic record and do not require physical or digital signature where acceptance is validly recorded through the Platform. PPIPL will maintain records of the version accepted, date, time and other reasonably required acceptance details.

2ELIGIBILITY AND AUTHORITY

  1. 2.1

You must be at least eighteen (18) years old and legally competent to enter into these Terms.

  2. 2.2

If you provide information about a Co-Applicant, guardian or collateral owner, you must do so only with that person’s knowledge and participation. You must not accept a notice, consent or credit-information authorisation on another person’s behalf unless legally authorised and expressly permitted by the Platform.

3NATURE OF THE PLATFORM AND PPIPL’S ROLE

  1. 3.1

The Platform enables you to provide and manage information relating to your education-loan Application, view potentially suitable loan options based on the information provided by you and request submission of your Application to one or more Lenders selected by you.

  2. 3.2

PPIPL facilitates the Application process but does not itself provide education loans or make the final lending decision. Any eligibility result, Lender recommendation, estimated loan amount, interest rate, annual percentage rate, tenure, repayment amount or other term displayed on the Platform is indicative and does not constitute a loan offer or sanction. The relevant Lender will independently verify your information and determine whether to process, approve, price, sanction and disburse the loan. The final terms applicable to your loan will be those communicated or issued by the Lender.

  3. 3.3

The Platform covers only those Lenders and loan products made available through PPIPL’s arrangements and does not represent every education-loan product available in the market. At your request or with your authorisation, PPIPL may communicate with a Lender regarding revised terms or submit your Application to another Lender. PPIPL will not submit your Application to another Lender unless you select or otherwise authorise that Lender through the applicable Application journey.

  4. 3.4

Where loan options from more than one participating Lender match the information provided by you, the Platform will display the matching options and the information required under Applicable Law. Matching will be based on the information provided by you and the applicable eligibility criteria communicated by participating Lenders.

4ACCOUNT AND APPLICATION PROCESS

  1. 4.1

You may be required to create an account (“Account”) and submit an education-loan application (“Application”). You must provide accurate, complete, current and verifiable information and promptly correct any material change.

  2. 4.2

The Application may include personal, educational, employment, income, banking, tax, credit, identity, immigration, loan and collateral information relating to you and one or more Co-Applicants. The information and documents collected at each stage will be limited to the applicable purpose described in the Privacy Notice or collection screen.

  3. 4.3

You are responsible for maintaining the confidentiality of your Account credentials and for activities conducted through your Account. You must immediately notify PPIPL if you suspect unauthorised access.

  4. 4.4

PPIPL may decline to process or submit, pause or require correction of an Application that is incomplete, inconsistent, unverifiable, duplicated or reasonably suspected to involve impersonation, fraud or altered documents.

  5. 4.5

Any processing fee, legal charge, valuation charge, insurance premium, tax or other amount charged by a Lender is governed by the Lender’s documents and must be paid by you only through the approved channel identified by that Lender. Loan disbursal and repayment will not pass through PPIPL unless expressly permitted by Applicable Law and disclosed in writing.

5CO-APPLICANTS AND CREDIT INFORMATION

  1. 5.1

Where you include one or more Co-Applicants in an Application, their information may be considered for identifying potentially suitable Lender options and will be subject to the relevant Lender’s independent verification and eligibility criteria.

  2. 5.2

You must provide information relating to a Co-Applicant only with that person’s knowledge and valid authorisation. PPIPL may use the credit-related information provided through the Platform for indicative evaluation and facilitation of the Application and may share it with one or more Lenders selected and authorised by you.

  3. 5.3

PPIPL does not obtain a credit report or independently verify the credit-related information provided through the Platform. The relevant Lender may independently verify such information, obtain credit information and conduct its own due diligence in accordance with its procedures and Applicable Law.

6DOCUMENTS AND COLLATERAL INFORMATION

  1. 6.1

The Platform may request documents, including identity, academic, admission, income, tax, banking, photograph, credit-related and collateral documents, only to the extent reasonably required to facilitate the Application or transmit it to one or more Lenders selected and authorised by you.

  2. 6.2

You confirm that documents submitted by you are authentic, current, complete, lawfully obtained and not forged, altered or misleading. You must not upload information unrelated to the Application or information you are not authorised to disclose.

  3. 6.3

Where an Aadhaar document is requested, it must be provided in the form specified on the applicable collection screen and permitted under Applicable Law. PPIPL does not conduct Aadhaar authentication or offline verification. Any such authentication or verification will be independently undertaken by the selected Lender in accordance with its applicable terms, privacy notice and Applicable Law.

  4. 6.4

PPIPL does not independently authenticate or verify documents submitted through the Platform and does not guarantee their authenticity, validity, legal sufficiency or acceptance by any Lender. The relevant Lender may independently verify the documents and request additional information or documents.

  5. 6.5

For a secured Application, the relevant Lender will independently determine whether the proposed collateral is acceptable and may require valuation, title verification or additional documents. PPIPL does not independently verify or guarantee the ownership, legal title, market value, enforceability or acceptance by any Lender of the proposed collateral.

7LENDER SELECTION AND APPLICATION SHARING

  1. 7.1

Your Application and documents will be shared with one or more Lender(s) selected and authorized by you through the Platform.

  2. 7.2

Where you request or authorise PPIPL to seek a revised offer or another Lender option, PPIPL may transmit the information reasonably required for that purpose. Any new sharing will be recorded and governed by the applicable notice and authorisation.

  3. 7.3

Documents may be transmitted to the selected Lenders through a password-protected ZIP file or another secure transmission method adopted by PPIPL. PPIPL will use reasonable technical and organisational safeguards appropriate to the nature of the information and will limit access to authorised recipients.

  4. 7.4

After a Lender receives an Application, that Lender may independently process and retain the information under its own notices, legal obligations and contractual arrangements. PPIPL does not control the Lender’s independent credit decision or processing.

8APPLICATION TRACKING

  1. 8.1

The Platform may show stages such as Application Submitted, Documents Collected, Lender ID Created, Secured Documentation Required, Verification Completed, Loan Approved, Processing Fee Paid and Further Action Required.

  2. 8.2

Status information is based on updates received from the relevant Lender and may be entered manually by authorised PPIPL personnel. The status displayed on the Platform may not reflect real-time developments at the Lender’s end.

  3. 8.3

Displayed timelines are estimates unless expressly confirmed in a Lender document. PPIPL does not guarantee a login, sanction or disbursement within any stated period.

9YOUR OBLIGATIONS AND PROHIBITED CONDUCT

  1. 9.1

    You must:

    1. a)use the Platform only for a genuine education-loan enquiry or Application;
    2. b)provide accurate information and promptly respond to verification requests;
    3. c)protect Account credentials and devices used to access the Platform;
    4. d)comply with Applicable Law and the Lender’s lawful requirements; and
    5. e)notify PPIPL of suspected fraud, impersonation or unauthorised access.
  2. 9.2

    You must not:

    1. a)submit forged, manipulated, stolen or misleading information or documents;
    2. b)impersonate another person or use their information without authority;
    3. c)interfere with Platform security, scrape data, reverse engineer the service or introduce malicious code;
    4. d)use the Platform for unlawful lending, fraud, money laundering or any unrelated purpose; or
    5. e)misuse Lender or PPIPL names, content or intellectual property.

10COMMUNICATIONS

  1. 10.1

PPIPL and its authorised service providers may contact you for Application-related purposes through calls, email, SMS or WhatsApp. A Lender selected by you may contact you separately in connection with the Application in accordance with its applicable terms and privacy notice.

  2. 10.2

Promotional communications unrelated to an active Application will be sent only in accordance with Applicable Law and your recorded preferences. You may opt out of these communications at any time by emailing contact@college.money. Opting out will not prevent us from sending communications required by Applicable Law.

  3. 10.3

Withdrawal from promotional communications will not prevent communications reasonably necessary to process, secure or close an existing Application.

11PRIVACY, SECURITY, RETENTION AND WITHDRAWAL

  1. 11.1

PPIPL will process personal data in accordance with the Privacy Notice as per Applicable Law. These Terms do not replace the Privacy Notice or any separate credit-information authorisation.

  2. 11.2

PPIPL may use service providers for hosting, storage, identity checks, communications, analytics, security and operational support, subject to appropriate contractual and security controls.

  3. 11.3

The confirmed data-storage and processing locations are in India.

  4. 11.4

Application records and documents will be retained for 45 (forty-five) days from the date of disbursal or for the period reasonably required for the stated purpose, lender transfer, audit, reconciliation, fraud prevention, dispute handling or legal compliance, and will then be deleted or anonymised in accordance with the Applicable Laws.

  5. 11.5

You may request access, correction, withdrawal, deletion or grievance handling by writing to us at nisha@cashkaro.com, priyam.sameer@cashkaro.com, subject to Applicable Law and limitations that apply after information has been shared with an independent Lender.

  6. 11.6

Withdrawal may prevent further evaluation or processing but will not automatically reverse disclosures already made or require deletion of records that PPIPL or a Lender must lawfully retain.

12THIRD-PARTY SERVICES

  1. 12.1

Selected Lenders may independently engage credit bureaus, valuation providers, educational institutions and other third parties for processing the Application. Their activities may be governed by separate terms and privacy notices.

  2. 12.2

PPIPL is responsible for its own Platform and conduct but is not responsible for independent decisions, systems, delays, acts or omissions of a Lender or other third party that are outside PPIPL’s reasonable control.

  3. 12.3

Links or references to third-party websites are provided for the applicable journey and do not constitute an unrestricted endorsement of all third-party content or services.

13INTELLECTUAL PROPERTY & CONFIDENTIALITY

  1. 13.1

The Platform, its software, interface, workflows, text, graphics, compilation and PPIPL-owned marks are owned by or licensed to PPIPL. Lender and third-party marks remain the property of their respective owners.

  2. 13.2

You receive a limited, revocable, non-exclusive and non-transferable right to use the Platform for your personal Application. You may not copy, commercialise, scrape, reverse engineer, interfere with or create derivative works from the Platform except as permitted by law.

  3. 13.3

You agree not to circumvent, disable, or otherwise interfere with security-related features of the Platform or features that prevent or restrict the use or copying of any materials or enforce limitations on the use of the Platform or the materials therein. The Platform is protected to the maximum extent permitted by copyright laws, other laws, and international treaties. The content displayed on or through the Platform is protected by copyright as a collective work and/or compilation, under copyright laws. The materials on the Platform or otherwise must not be modified, copied, reproduced, distributed, republished, downloaded, displayed, sold, compiled, posted, or transmitted in any form or by any means by you, including but not limited to, electronic, mechanical, photocopying, recording or other means.

  4. 13.4

We shall adhere to all obligations imposed by law regarding the handling, processing, and protection of your personal information (PI). Your personal data will be treated with confidentiality and care, and we will take appropriate measures to safeguard it against unauthorized access, disclosure, alteration, or destruction. These measures will be in compliance with the applicable data protection laws and regulations. Any disclosure of your personal data to third parties will be made in accordance with applicable laws and regulations, including obtaining your explicit consent when required.

  5. 13.5

In the event of any breach of data protection laws or regulations, we will inform you promptly and take steps to address any potential adverse effects arising from such a breach. By using the Platform, you agree to these Terms and we shall not be held liable for any disputes arising from the handling of your personal data, except as required by law.

14COMPLIANCE WITH APPLICABLE LAWS

  1. 14.1

You must comply with all Applicable Laws when accessing or using the Platform, submitting or managing an Application, or providing information or documents through the Platform. PPIPL will comply with the Applicable Laws governing its operation of the Platform and facilitation of Applications. Each person will be responsible for obtaining and maintaining any licence, permission, authorisation or registration legally required for its own activities under these Terms.

15SUSPENSION, CLOSURE AND TERMINATION

  1. 15.1

PPIPL may restrict, suspend or close an Account or Application where reasonably necessary for security, suspected fraud, material breach, legal or Lender requirements, inaccurate information, Platform discontinuation or protection of users and systems.

  2. 15.2

Where practicable and lawful, PPIPL will provide notice or an opportunity to correct a remediable issue. Immediate restriction may occur where delay may create security, fraud, regulatory or third-party risk.

  3. 15.3

Closure of an Account does not automatically cancel an Application already submitted to a Lender. You may need to contact the Lender separately.

16DISCLAIMERS

  1. 16.1

The Platform is provided on an “as available” basis. PPIPL will use reasonable efforts to maintain availability and security but does not guarantee uninterrupted, error-free or vulnerability-free operation.

  2. 16.2

PPIPL does not guarantee lender participation, eligibility, approval, sanction, loan amount, interest rate, processing time, disbursement, admission, visa outcome or any other result.

  3. 16.3

Nothing in these Terms excludes a responsibility that cannot lawfully be excluded or limited, including responsibility arising from PPIPL’s own fraud, wilful misconduct or other non-excludable liability.

  4. 16.4

Any information, comparison or recommendation made available through the Platform is provided solely to facilitate your evaluation of available loan options and does not constitute personalised financial, legal or tax advice. Before accepting a loan, you should carefully review the relevant Lender’s Key Fact Statement, sanction letter, loan agreement, applicable fees, security requirements and repayment obligations.

17LIMITATION OF LIABILITY

  1. 17.1

Subject to Clause 16.3 and to the maximum extent permitted by Applicable Law, PPIPL and its directors, officers, employees and agents will not be liable for any indirect, incidental, special, exemplary, punitive or consequential loss, including any loss of opportunity, anticipated savings, profit, goodwill or business, arising out of or relating to the Platform, an Application, these Terms or your inability to access or use the Platform, regardless of the legal basis of the claim.

  2. 17.2

PPIPL will not be liable to the extent that any loss or damage arises from:

    1. a.inaccurate, incomplete, outdated, forged, misleading or unauthorised information or documents submitted by you;
    2. b.an independent decision, act, omission, delay, system or requirement of a Lender or another third party;
    3. c.suspension, interruption or unavailability of the Platform caused by maintenance, internet or telecommunications failure, a third-party system or another event beyond PPIPL’s reasonable control; or
    4. d.your failure to protect your Account credentials, follow reasonable security instructions or comply with these Terms.
  3. 17.3

Subject to Clause 16.3, PPIPL’s aggregate liability for any direct loss actually suffered and directly caused by PPIPL’s breach, negligence or omission in connection with the Platform, an Application or these Terms will not exceed INR 500 (Indian Rupees Five Hundred). This limit applies cumulatively to all claims, regardless of whether they arise in contract, tort, statute or otherwise.

  4. 17.4

The exclusions and limitations under this Clause apply only to PPIPL and do not limit any independent responsibility or liability owed to you by a Lender or another third party.

18INDEMNITY

  1. 18.1

You agree to indemnify, defend and hold harmless PPIPL and its directors, officers, employees and agents (collectively, the “Indemnified Persons”) from and against any claims, proceedings, liabilities, losses, damages, penalties, costs and expenses (including reasonable legal fees) arising out of or relating to:

    1. i)any harm to the Platform, loss of data or system slowdown caused by code or other content that you download, install, upload or introduce through the Platform;
    2. ii)your sharing or disclosure of your Account credentials to any other person;
    3. iii)any third-party claim arising from your use of the Platform in breach of these Terms or Applicable Law; or
    4. iv)your breach of any obligation, representation or warranty under these Terms.
  2. 18.2

Though we take the utmost care and the most stringent measures to ensure that the information present on the Platform is accurate and up to date, we do not take any liability for any error or omission or any loss arising from the same.

19FORCE MAJEURE AND PLATFORM CHANGES

  1. 19.1

PPIPL will not be liable for delay or failure caused by an event beyond its reasonable control, provided it takes reasonable steps to mitigate the effect where practicable. This does not excuse obligations that can reasonably continue or any payment already due.

  2. 19.2

PPIPL may modify, suspend or discontinue Platform features. A material change affecting your rights will be notified through the Platform, registered contact details or another reasonable channel and will apply prospectively unless law requires otherwise.

20GRIEVANCE REDRESSAL

  1. 20.1

The details of the Grievance Officer of the Platform are as follows:

    Name: Qaisar Farooq

    Designation: Director of Customer Experience

21GOVERNING LAW AND JURISDICTION

  1. 21.1

These Terms shall be governed by and construed in accordance with the laws of India. Any dispute, controversy, or claim arising out of or relating to these Terms, including its formation, interpretation, performance, or termination, shall be exclusively resolved by the courts of New Delhi, India.

  2. 21.2

In the event of a dispute, the parties shall first attempt to resolve the matter amicably through good-faith negotiations. If such negotiations do not result in a resolution within a reasonable period, either party may initiate legal proceedings under the governing law and jurisdiction specified herein.

  3. 21.3

Both parties agree to submit to the personal jurisdiction of the courts of New Delhi to litigate any such dispute, controversy, or claim. We, in any such dispute, shall be entitled to recover reasonable attorneys' fees and costs incurred in connection with resolving the dispute.

22GENERAL

  1. 22.1

If any provision is held invalid or unenforceable, the remaining provisions will continue to apply and the affected provision will be limited to the minimum extent necessary.

  2. 22.2

Failure to enforce a right is not a waiver. A waiver must be in writing and applies only to the matter stated.

  3. 22.3

You may not assign your Account or rights under these Terms. PPIPL may transfer these Terms as part of a corporate reorganisation, business transfer or transfer of the Platform, subject to Applicable Law and continued protection of your rights.

  4. 22.4

These Terms, the Privacy Notice, collection notices and any Lender documents applicable to the selected loan journey constitute the relevant terms for their respective subject matter. A Lender document does not transfer that Lender’s obligations to PPIPL.

  5. 22.5

Clauses concerning data already processed, intellectual property, liability, indemnity, disputes and other provisions intended by their nature to continue will survive Account closure.

  6. 22.6

Headings are included for convenience only and do not affect the interpretation of these Terms. These Terms supersede prior communications concerning your use of the Platform, without limiting the applicability of the Privacy Notice or any relevant Lender documents.

  7. 22.7

You acknowledge that the Platform does not engage in the sale or purchase of goods/products and cannot ensure the quality or merchantability of the services availed. We bear no liability for mediating or resolving conflicts between you and the Lender. Additionally, the Platform does not endorse or guarantee the accuracy, reliability, or quality of products, services, or information provided by the Lender or third parties. Any statements or representations made by Lender or third parties are their own, and transactions with them are solely between you and the respective Lender, with you assuming all associated risks.

  8. 22.8

While PPIPL will use reasonable efforts to maintain the functionality, availability and security of the Platform, access may occasionally be interrupted, delayed or affected by errors due to maintenance, internet or telecommunications failures, Lender or third-party systems, or other circumstances beyond PPIPL’s reasonable control. PPIPL will take reasonable steps to address such issues where practicable but does not guarantee uninterrupted or error-free access to the Platform.

  9. 22.9

You further acknowledge and consent that you are accessing and transacting through this Platform at your discretion and risk, and that you are exercising your best and reasonable judgment before entering into any transaction through the Platform.

  10. 22.10

We assume no responsibility for any errors or inconsistencies made by Platform or third parties.

  11. 22.11

It is recommended that you thoroughly read the description, terms & conditions, before availing or applying for the services and/or education loan applications.

  12. 22.12

In the event that any education loan product is displayed with inaccurate details as a result of a typographical error or error in the content of the deal understanding received by the Lender, we and/or the Lender reserve the right to reject or revoke any applications placed through such incorrect product details.

  13. 22.13

In case you reproduce any third-party content from the Platform that infringes on any person including the Lender’s Intellectual Property rights, you will bear full responsibility for any resulting liabilities or expenses, and we disclaim any responsibility for such actions.

  14. 22.14

We reserve the right to modify, suspend, or discontinue any aspect of the services, including features, databases, or content, at any time without prior notice. We may also terminate your access to the Platform at our discretion, in which case all rights and licenses granted to you under these Terms will cease, and you must stop using the Platform. We shall not be liable to you or any third party for any such action.

  15. 22.15

The services provided by us through the Platform are available and appropriate only for use in India.

  16. 22.16
